Real estate litigation: Hospital and linen company charged

When construction or other defects in buildings in Texas and elsewhere cause harm to occupants of those buildings, the victims or their surviving family members may hold the property owners responsible. Real estate companies must ensure properties on their books are safe -- this applies to construction and other issues such a toxic mold accumulations. A hospital and business in another state are currently fighting lawsuits alleging mold caused the deaths of two people.

A linen service company faces accusations of providing linen to a hospital at which two transplant patients died. Allegedly, both patients' deaths resulted from mold presence in their lungs. The first victim was a 56-year-old kidney transplant patient who died in July 2016, and then a 70-year-old patient died in February after undergoing a lung transplant.

Reportedly, the hospital where the deaths occurred settled two previous lawsuits for mold-related deaths, but the linen supplier is also targeted this time. The hospital used experts to inspect the building of the linen company, and mold of the same nature as the mold found in the lungs of the victims was discovered at the linen company. However, the U.S. Centers for Disease Control and Prevention suggested the hospital's ventilation system might be inadequate.

When a real estate owner in Texas faces a lawsuit related to the safety of a building, it can lead to complicated litigation. The logical step might be to retain the services of an experienced real estate litigation attorney to handle the complaint on his or her behalf. This is a field of the law filled with complex challenges that a skilled attorney can navigate by working to achieve the best possible outcome.
